We will keep you informed via the website of any changes to these terms and conditions of use, the general terms and conditions, the privacy policy and/or the cookie policy. You accept these changes fully and unconditionally each time you visit our website.

9. Our complaints procedure is simple and efficient

1.2 The Website consists of the following: Administrative formalities for companies (hereinafter: the “Service“).
1.3 Any questions or complaints regarding the Website, these Terms and Conditions of Use (hereinafter: “Terms and Conditions of Use“), the General Terms and Conditions (hereinafter: “General Terms and Conditions“), the Privacy Policy (hereinafter: “Privacy Policy“) and the Cookie Policy (hereinafter: “Cookie Policy“) can be directed to AD-MINISTERIE at the above address or at the following e-mail address: mail@ad-ministerie.be.
2. ACCEPTANCE
2.1 Access to the Website is subject to these Terms and Conditions of Use, the Privacy Policy, the Cookie Policy and applicable laws and regulations. Accordingly, access to or use of the Website implies full and unconditional acceptance by the User (hereinafter the “User“) of these Terms and Conditions of Use, the Privacy Policy and the Cookie Policy.
2.2 These Terms and Conditions of Use, the General Terms and Conditions, the Cookie Policy and the Privacy Policy exclusively govern the relation between the User and AD-MINISTERIE relating to the use of the Website and the Service. They can be consulted at any time on the Website.
3. ACCESSIBILITY AND OPERATION OF THE WEBSITE
3.1 AD-MINISTERIE will, as much as possible, ensure that the Website is up-to-date and remains accessible to a normal number of Users. However, AD-MINISTERIE does not guarantee that the functions of the Website will be available without interruption or error, that defects will be corrected immediately or that the server that makes it available is free from viruses or other harmful components.
3.2 AD-MINISTERIE shall not be held liable for any loss or damage of any nature resulting from suspension, interruption, (technical) malfunction, delay, difficult access and/or discontinuation of access to all or part of the Website or viruses or other harmful elements present on the Website.
3.3 If the User finds an error, virus or other harmful elements on the Website, he is requested to notify AD-MINISTERIE at the following address: mail@ad-ministerie.be, so the necessary measures can be taken. In any event, AD-MINISTERIE advises the User to install firewalls, antivirus software and other necessary security software on his computer in order to prevent damage.
3.4 AD-MINISTERIE reserves the right to suspend or discontinue, in whole or in part, the Website, at any time, without justification and without prior information.
4. USE OF THE WEBSITE
4.1 The User agrees to use the Website only in accordance with its purpose, to the exclusion of any other purpose.
4.2 The User shall ensure that all information he communicates is accurate and up-to-date.
4.3 The User agrees to use the Website in good faith and to comply with the legislation in force, and in particular to refrain from:
- sending to AD-MINISTERIE any false or misleading content (and update such content, if necessary, to ensure that it does not become false or misleading), or any communication that appears to be obscene, racist or xenophobic, abusive unlawful, deceptive, intrusive, offensive, harmful, violent, threatening, intimidating, defamatory, infringing intellectual property rights or any other of these things;

- the extraction, by means of permanent or temporary transfers, of all or part of the content of the Website, or all or part of one or several types of data available on the Website, regardless of the extraction method used;
- the re-use, through public removal, of all or part of the content of the Website
- Sending content that refers to illegal websites or websites with inappropriate content to AD-MINISTERIE;
- using the Website to send unsolicited spam, pyramid schemes or similar fraudulent processes;
- bypassing technical protection measures for documents and multimedia;
- any action that could adversely affect the proper operation of the Website, the Service, including the use of computer viruses, ransomware or mass mailing;
- (attempted) unauthorised access to (part of) the Website or equipment (hardware and software) used for the proper operation of the Website;
- use of a false name, a pseudonym or use of the identity of someone else or an entity;
- use of the Website for purposes other than those described in these Terms and Conditions of Use.
4.4 AD-MINISTERIE cannot be held liable for any non-compliance by the User with the Terms and Conditions of Use, the General Terms and Conditions, the Cookie Policy, the Privacy Policy and/or any applicable laws or regulations. The User shall indemnify AD-MINISTERIE against any action, claim or complaint by third parties (including public authorities) relating to the use of the Website.
4.5 The User uses the Website entirely at his own risk. The Website, its components and all information, software, facilities and related services are provided as they are, subject to availability without any form of guarantee (neither explicit nor implicit) and within the limits of applicable law.
4.6 AD-MINISTERIE cannot be held responsible for any loss or damage (direct, indirect, material or immaterial) arising from the use of the Website and its components or the impossibility of using the Website in whole or in part.
4.7 The User shall immediately inform AD-MINISTERIE in writing if he/she becomes aware of any inappropriate behaviour or prohibited use related to the Website, by sending an e-mail to mail@ad-ministerie.be.
5. LINKS TO AND ON OTHER WEBSITES
5.1 The Website may display links to other Websites. These third-party websites are not controlled by AD-MINISTERIE, which cannot be held liable for their operation, content and use. Unless expressly stated otherwise by AD-MINISTERIE on the Website, the existence of such links does not imply any endorsement by AD-MINISTERIE with respect to these third-party websites or the use that might be made of them, nor any association or partnership with the operators of this/these Website(s)
6. INTELLECTUAL PROPERTY RIGHTS
6.1 The Website and its components (trademarks, logos, graphics, photos, animations, videos, music, texts, etc.) are the property of AD-MINISTERIE. They are protected by intellectual property rights (including copyright, design rights, trademarks, etc.) and may not be reproduced, used or distributed without the prior written consent of AD-MINISTERIE or, where applicable, the right-holder concerned, on penalty of infringement of copyright and/or design and/or trademark rights, punishable by three months to three years [custody] and a fine of 100 to 100,000 euros or any of these fines alone.
6.2 AD-MINISTERIE grants the User a non-exclusive, non-transferable licence, for an indefinite period of time and revocable at any time and without giving reasons, to access the content of the Website, to display it and to download it for display purposes only. The User may also print a copy of the content displayed on the Website for his personal needs, provided that it does not modify the content of the Website in any way and that it retains all references to authorship and origin of the Website. Reproduction is therefore authorised only for strictly personal purposes under Article XI.190 5° of the Code of Economic Law.
6.3 When you publish content on the Website, unless otherwise stated, you grant AD-MINISTERIE a free and non-exclusive license exclusively for the use of the Website and for the facilitation of services, to use, reproduce, adapt, publish, translate, create derivative works, distribute, perform and display such content worldwide on any medium of or related to the Website and its promotion, without any limitation as to your name, image or identity.
6.4 Any use of the Website and its components not covered by this section is strictly prohibited
7. REQUIREMENTS FOR PUBLICATION OF THE CONTENT
7.1 The User shall not publish any content on the website that could:
- – Mention information of third parties, such as addresses, telephone numbers, email addresses, social security numbers and credit card numbers;
- – be objectionable in AD-MINISTERIE‘s reasonable opinion, or that the use by another person of the platform or the Website may be hindered, or that AD-MINISTERIE or Users of the Website may incur their liability or cause damage.
The User shall be fully responsible for the content published on his/her profile and bear its consequences.
7.2 The User owns all content he/she publishes on the Website. The User confirms and assures that he/she has (a) all rights to the content he/she has published or for which the necessary authorizations for publication have been obtained; (b) the User’s content is accurate; and (c) the use and display of the content provided does not violate these Terms and Conditions of Use or any other right or harm or prejudice another individual or entity.
7.3 For use of the Website and for facility support purposes only, if the User publishes content on the Website, unless otherwise stated, he/she grants AD-MINISTERIE a non-exclusive and free licence to use, reproduce, adapt, publish, translate, create new derivative works, distribute, perform or display such content worldwide on any medium provided on or in connection with the Website and its promotion, and without any restrictions on the use of the User‘s name, image or identity.
AD-MINISTERIE shall not use the User‘s content or his/her name, image or identity for commercial or marketing purposes without his/her prior consent
8. REASONABILITY AND GOOD CONDUCT
8.1 AD-MINISTERIE cannot be held liable for all content posted, stocked or downloaded by a User via the User or another individual, or for any loss or damage, or a User‘s conduct, and AD-MINISTERIE shall not be held liable for any errors, defamation, omissions, false information, obscenity, pornography or blasphemy the User could encounter.
8.2 This provision does not create any legitimate or reasonable expectation that the Website may contain any content never previously cited. As a website provider, AD-MINISTERIE is not responsible for any statements, representations or content provided by its Users in any public forum, website, message or other communication.
8.3 Although AD-MINISTERIE is not authorised to filter, edit or control content posted on the Website, AD-MINISTERIE reserves the right, at its discretion, to include, filter or modify content posted or stored on the Website for any reason whatsoever and without prior notice. Users shall be the only ones entitled to copy or protect content they publish or store on the Website.
8.4 If content published by a User does not meet the provisions of the Terms and Conditions previously imposed, AD-MINISTERIE reserves the right to immediately and without prior notice to:
- suspend, delete, ask for content to be changed;
- ask a User to adjust the content;
- – block, suspend or delete the User‘s account.
8.5 The User can therefore not act as having any damage or claims of any kind. For this reason, the User is reminded that the specific criminal sanctions relating to the contested content (imprisonment and fines), other than any order to pay pecuniary damages.
8.6 In the event of a dispute between Users regarding content published by one of them, it is the Users’ duty to contact each other and find a solution to their dispute. AD-MINISTERIE is not expected to intervene and will not intervene in such dispute resolution. AD-MINISTERIE reserves the right not to follow up a User‘s claim addressed to it and without incurring any liability.
9. COMPLAINTS
9.1 Any possible claim/complaint by the User with regard to the Website must be communicated in writing within eight (8) calendar days after it has become known that there is reason to do so. The absence of any dispute in accordance with the aforementioned rules implies for the User the unconditional acceptance of the fact giving rise to the claim and, de facto, the definitive waiver of any claim pursuant to this point
10. CHANGES AND LANGUAGE VERSIONS
10.1 AD-MINISTERIE reserves the right to modify, at any time and without prior notice, these Terms and Conditions of Use, the General Terms and Conditions, the Privacy Policy and the Cookie Policy, as well as access to the Website and its content. These changes are binding for the User(s) at each visit of the Website. It is therefore recommended to consult them every time the Website is used; the date of the latest modification is indicated at the top of these Terms and Conditions of Use.
10.2 In the event of discrepancies between the language versions of these Terms and Conditions of Use, the General Terms and Conditions, the Privacy Policy or the Cookie Policy, the Dutch version shall prevail
11. VALIDITY OF CONTRACTUAL CLAUSES
11.1 AD-MINISTERIE’s failure to use/enact any of the provisions of these Terms and Conditions of Use for a period of time shall in no way be construed as a waiver of such rights at a later time.
11.2 The nullity, invalidity or unenforceability of any part of the provisions implies by no means the invalidity of all provisions. A provision that is invalid, void or unenforceable in whole or in part shall be considered unwritten. AD-MINISTERIE undertakes to replace this provision with another one which, as far as possible, pursues the same objective.
12. APPLICABLE JURISDICTION AND COMPETENT COURT
12.1 The validity, interpretation and/or execution of the Terms and Conditions of Use are subject to Belgian law only, to the maximum extent allowed by the applicable rules of private international law.
12.2 In the event of a dispute concerning the validity, interpretation or implementation of the Terms and Conditions of Use, the courts of the judicial district of Brussels (Dutch-language) shall be sole competent.
12.3 Before taking legal action, the User and AD -MINISTERIE shall endeavor to resolve the dispute amicably. To this end, they will first contact, where appropriate and necessary, a mediator, arbitration or any other alternative method of dispute resolution.
