Itinerant trade

An activity of selling goods or services to private individuals by a trader outside their own establishment or, overall, by any other person, is subject to authorisation.

Various authorisations

The authorisation as an employer in the name of the company director allows the activity to be carried out in all places, including at the home of the private individual.

The authorisation employee B in the name of the person themselves allows the activity to be carried out in all places, including at the home of the private individual.

The authorisation employee A in the name of the company allows activities to be carried out in all places other than the home of the consumer and is interchangeable among the employees.

Where and when is itinerant trade performed?

  •  the public markets.
  • private markets with the permission of the municipality.
  • the public domain.
  • the private places adjacent to the public road and the commercial parking places subject to prior authorization of the municipality and the owner of the place.
  • stations, airports and metro halls.
  • shopping malls.
  • fairs, only for itinerant activities in the field of fairground gastronomy.
  • bars, hotels and restaurants, but only for the sale of flowers.
  • public markets.
  • at the consumer’s home between 8 a.m. and 8 p.m.

Exemptions

  • Selling to promote local trade or the life of the municipality.
  • Trade fairs and exhibitions.
  • Selling own products from a stall in front of the shop.
  • Selling by a trader at the premises of another trader.
  • Selling as part of a temporary promotion.
  • At the consumer’s home at the consumer’s request.
  • Home party.
  • Sale at the place of production by farmers, horticulturists and growers.
  • Flea markets as an occasional seller.
  • Sale for social, cultural or provocative purposes, to protect nature or to promote crafts and local products.

Where to apply?

The itinerant trade authorisations can be applied for at a recognised enterprise counter. Some activities require permission from the municipal authority.
